The Kyiv Terminal company, the beneficiary of which is a businessman of Russian-Georgian origin (now a British citizen) Tamaz Somkhishvili, is trying to sue the KCSA for about UAH 4 billion. Activists report that an SSU officer who conducted investigative actions in this case was killed. This is stated in the article by Ukrainian News on the eve of the court hearing.
According to the publication, in 2007, the little-known company Kyiv Terminal, the beneficiary of which is the Russian-Georgian businessman Tamaz Somkhishvili, won the KCSA competition for the reconstruction of Kharkiv Square, but never began work, and instead began to demand compensation ‘for losses and lost profits’.
“At that time I was Deputy Chief Architect of Kyiv. I can confirm that there were no accounting or legal documents, no decisions between Kyiv Terminal and the Kyiv City Council. This is a pure water scam. Even the project for the construction of a transport interchange was not developed and approved,” informs urban planning expert Viktor Gleba. According to Viktor Gleba, the investment agreement was terminated due to violation of the law, forgery of signatures and false information. In turn, according to the ex-official, the lease of land with forgery of documents and knowingly false information was canceled, the permit for construction or reconstruction was not issued.
In 2013, the investment agreement with the consent of both parties was terminated. But at the end of 2018, when the statute of limitations for appealing against this decision had long expired, Kyiv Terminal appealed to the Economic Court of Kyiv with a lawsuit to the Kyiv authorities for a total amount of $100 million. The Economic Court partially satisfied the plaintiff's claims, the appellate instance refused, but the Supreme Court returned the case to appeal.
Activists and human rights advocates are outraged by the very fact of continuation of the trial, noting that, taking into account the biography of the beneficiary of Kyiv
Terminal, his activities on the territory of Ukraine during the war with Russia should have long been suspended by law enforcement agencies.
“Somkhishvili, known in certain circles as ‘Tamaz Tobolsky’, graduated from physics and mathematics faculty in Tobolsk, received a financial education in Tiumen and is one of the co-founders of the ANO Tennis Club "Lukoil”. Kiev Terminal is not just a mafia, but a Russian mafia. This is a Georgian thief-in-law, who now refuels Russian tanks. I personally wrote a statement to the SSU. The service officer who conducted the investigation was killed. This issue should be dealt with by the SSU, this is a matter of national security," Viktor Gleba was quoted as saying by Ukrainian News.Kyiv activists also believe that there are all signs of sabotage and hybrid war of the Russian Federation against Ukraine.
“In my opinion, this trial is nothing more than a hybrid special operation of the Russian special services, because it occurs when every hryvnia is important. There are power outages in the city, and it is not known when the next missile and drone strike may occur, which will cause new losses to the capital," blogger and media analyst Nazar Prykhodko commented to the publication.
Human rights activists call for Tamaz Somkhishvili to be added to the sanctions list and his property in Ukraine arrested.
"If the judges rule in favour of the Russian oligarch, it is not just treason. It is also a way to drive every Kyiv resident into debt, because it is we who have to give these funds. I think that there will be a lot of willing Kyivans who will ask each judge what legal reasoning they were guided by when accepting this treason. I would also like the SSU to take a closer look at the panel of judges of the Supreme Court, which ruled in favour of the Russian. Somkhishvili was General Director and is a shareholder of the Russian Lukoil. I am addressing the National Security and Defense Council. Why is Somkhishvili still not under sanctions?" human rights activist Oleksandr Aronets tells the publication.
